Terms of use and API conditions

The rules for using this site, which is free, and the API, which is sold by subscription: what the prices are and what they are not, what a plan includes, what you may do with the data, and how to withdraw, cancel or complain.

Who we are, and what these terms cover

Aurum Feed is published by Ivan Capponi, Piazza Fratelli Ruffini SNC, 18011 Castellaro (IM), Italy — VAT number IT01837890084, Italian tax code CPPVNI94R27D969T, business register (REA) IM-250007. These terms cover the use of the site and, for whoever subscribes to a plan, the API that serves the same data to programs. The privacy policy and the cookie policy say what happens to personal data; the page for dealers says how the prices are read.

What the site is

A comparator of gold coin and bar prices. It reads the prices dealers publish on their own pages, compares them on the metal they contain, and links to the dealer’s page. Using it is free, needs no account and asks for nothing in return.

Aurum Feed sells no coins or bars, takes no commission, and no dealer can pay to rank higher. A purchase is a contract between you and the dealer, made on the dealer’s site and under the dealer’s terms: we are not a party to it and cannot answer for it — for delivery, payment, the condition of what you buy or the dealer’s conduct.

What the prices are, and what they are not

Every price is the dealer’s own, as its page showed it when it was read, VAT as the dealer shows it, before shipping and payment fees. It may have changed since, or have been read wrongly: every price carries how long ago it was read, and the total that counts is the one on the dealer’s page. A price converted into another currency, at the day’s ECB reference rate, is a guide: the dealer charges in its own currency.

Nothing on the site is investment advice or an invitation to buy or sell. The typical price, the premium over spot, the rankings and the notes describe the market; what to do about it is your decision.

Using the site

You may read the site, link to any page of it and quote it briefly, saying where it comes from. A program that reads its pages should follow its robots.txt and keep to a pace that does not burden it — the same rules this site keeps with the dealers — and to read the data by program there is the API, which is what it is for.

The text, the design and the code of the site belong to the publisher, and so does the database of prices and dealers as it is collected, checked and arranged here (art. 102-bis of Italian copyright law, no. 633/1941). The prices are the dealers’, as are their names and marks; the coin photographs are used under the licences listed on the how it works page.

An account

Signing in with a Google or Microsoft account is optional: it is needed only for the premium alerts and to subscribe to the API. The account is yours alone, and so is what is done with it. An API key is a password: keep it out of public code, and rotate it from the dashboard the moment it leaks. To subscribe you must be of age.

The API: plans and prices

Without a key the feed, the history and the exchange rates answer, with no budget of your own; the other resources, and a budget, come with a plan. The plans, what each includes — requests a month, requests a minute, resources — and their monthly prices are those shown on the developers page and in the dashboard on the day you subscribe. Prices are shown in euro, VAT excluded; the amount charged, VAT included where it is due, is the one the payment page shows before you confirm.

A request over the minute’s limit, or over the month’s budget, is answered with a 429 that says when to try again; a resource the plan does not include, with a 403; a key whose subscription is not active, with a 402.

The API: subscribing, paying, cancelling

You subscribe from the dashboard and pay by card through Stripe, with PayPal, or — for a company with an Azure subscription — through Microsoft’s Azure Marketplace, on the Azure invoice. The contract is concluded when the payment provider confirms the payment; the key is issued at that moment, and the subscription renews every month until it is cancelled.

You can cancel at any time, from “manage subscription” in the dashboard or on the provider’s side: the renewals stop and nothing more is charged. Paid by card, the plan stays active until the end of the month already paid. Through PayPal, the plan ends when PayPal reports the cancellation: write to us and we refund the days of the month left. Bought on Azure Marketplace, the subscription is cancelled and billed on Microsoft’s side, under the marketplace’s rules.

A change of plan applies as soon as the provider confirms it, and the provider settles the difference on the next invoice. Outside the cases above and the right of withdrawal, the part of a month already paid is not refunded.

Right of withdrawal, for private persons

If you subscribe as a consumer — a private person acting outside any trade or profession — you may withdraw from the contract within 14 days of the day it was concluded, without giving a reason (art. 52 of the Italian Consumer Code). To do so, tell us clearly, by e-mail or certified e-mail, before the 14 days are over; you may use the model form below, but you do not have to.

We refund what you paid within 14 days of receiving your withdrawal, by the same means you paid with. Because subscribing asks for the service to start at once, as the dashboard says before you pay, you pay for the days of service up to your withdrawal, in proportion to the month (art. 57(3)); the rest is refunded.

Model withdrawal form — To: Ivan Capponi, Piazza Fratelli Ruffini SNC, 18011 Castellaro (IM), Italy, info@ivancapponi.com. I hereby give notice that I withdraw from my contract for the following service: Aurum Feed API, plan …, subscribed on …, account e-mail …. Name …. Date ….

As a consumer you also have the legal guarantee of conformity for digital services (arts. 135-octies and following of the Consumer Code): if the API does not work as these terms describe, write to us and we bring it back into conformity, or reduce the price or end the contract, as the law provides.

What you may do with the data

With a plan you may use the data in your own sites, apps, analyses and services, commercial ones included, on four conditions:

  • say where it comes from — “prices: Aurum Feed” — wherever you show it;
  • show a dealer’s price with the time it was read and, where your page can carry a link, the link to the dealer’s product page that the API gives with it;
  • do not pass the data on as data: no reselling or republishing the feed, the history or the graph in bulk, and no price API or dataset of your own built from ours;
  • do not present a price as current when it is not, and take a dealer’s prices down when they leave the API: a dealer that asks to leave the comparator leaves the API too.

The dealers’ names and marks are theirs: you may name a dealer next to its price, not suggest that it endorses you. The licence is yours alone, cannot be transferred, and ends with the subscription.

How the API is served

The API serves the data as the hub has it, with the same caveats as the site: a price can be late, wrong or missing, a dealer can stop being read, and the service can be interrupted for maintenance or by a fault. We work to keep it running and correct, but we do not promise a level of availability unless one is agreed in writing.

The API is versioned — v1 today. A change that breaks v1 is announced by e-mail to subscribers at least 30 days before it applies; additions that break nothing can come at any time.

We may suspend a key that is used against these terms, that has leaked, or whose subscription is unpaid, telling you why; for a serious breach we may end the subscription. If we end it through no fault of yours, we refund the part of the month left.

Liability

The site and the data are provided as they are. We answer for our own obligations under these terms, not for the dealers — for their prices, their stock, their sales or their sites — nor for decisions taken on the strength of a price, or for losses that could not be foreseen when the contract was made.

Towards a business customer our liability for the API is limited to what was paid for it in the twelve months before the event. Nothing in these terms limits liability for wilful misconduct or gross negligence (art. 1229 of the Italian Civil Code), or a consumer’s rights that the law does not allow to be limited.

Changes to these terms

These terms change when the site or the API does; the date at the top is that of the last revision. For a subscriber, a change that affects the subscription is announced by e-mail at least 30 days before it applies, and you can cancel before then at no cost; for everyone else the version on this page applies from its date.

Law, courts and complaints

These terms are governed by Italian law. A consumer may bring proceedings before the court of the place where they live, which is also the only court where they can be sued (art. 66-bis of the Consumer Code); a consumer living in another EU country keeps the protections of that country’s law that cannot be waived. For a business customer the court of Imperia has exclusive jurisdiction.

For any complaint, write to info@ivancapponi.com or by certified e-mail to ivan.capponi@pec.it: we answer within fourteen days.

The Italian and the English version of these terms say the same thing; should they ever differ, the Italian one prevails.
